Arkansas

States are increasingly considering laws establishing employment eligibility verification requirements. In Arkansas, one such bill has already been enacted and three are currently pending. Though the demand for quick action that compels Arkansas lawmakers and their colleagues across the nation is understandable, creating a patchwork of uncoordinated verification systems undermines the efficacy of existing and potential federal approaches.

Act 157: Final version (February 28, 2007) prohibits state agencies from entering into contracts with businesses that knowingly employ or contract with unauthorized workers. Prior to the award of a state contract - typically before or during the bidding phase - contractors as well as subcontractors must certify that they do not employ or contract with undocumented workers.
